अम्बेडकरनगर। वाहन चालकों व वाहन मालिकों को दिया गया निर्देश

अम्बेडकरनगर। मा0 उच्च न्यायालय, इलाहाबाद खण्डपीठ लखनऊ के समक्ष योजित जनहित याचिका संख्या 15385 / 2021 में मा0उच्च न्यायालय द्वारा आदेश दिनांक 20.07.2021 के क्रम में ध्वनि निकलने पर दुपहिया मोटरयानों विशेषतया बुलेट मोटर साइकिल के स्वामियों / चालकों द्वारा साइलेंसर को इस प्रकार परिवर्तित करने पर कि उसमें निर्धारित ध्वनि मानक 80 डेसीबल से अधिक ध्वनि निकलने पर सख्त कार्यवाही करने के आदेश पारित किए गये हैं।

गौरतलब है कि मा०उच्च न्यायालय के आदेश दिनांक 20.07.2021 के अनुपालन में आम जनमानस को सूचित किया जाता है कि वे अपने दुपहिया मोटरयानों विशेषतया बुलेट मोटर साइकिल पर परिवर्तित साइलेंसर न लगाये यदि परिवर्तित (मॉडिफाइड) साइलेंसर लगा पाया जाता है तो Motor Vehicle Act, 1988/ Noise Pollution (Regulation and Contral) Rules. 2000/Central Motor Vehicle Rules, 1989/ Relevant provisions of Cr.P.C/Indian Penal Code / Environment Protection Act, 1986 read with Environment Pollution Rules, 1986 and various judgements pronounced by Hon'ble Constitutional Courts के अन्तर्गत मोटरयान अधिनियम की धारा-190 (2) के अन्तर्गत जो कोई व्यक्ति किसी सार्वजनिक स्थान में कोई मोटरयान ऐसे चलायेगा या चलवायेगा या चलाने देगा, जिसमें सड़क सुरक्षा, शोध नियंत्रण और वायु प्रदूषण के सम्बन्ध में विहित मानकों का उल्लंघन होता है, तो वह प्रथम अपराध के लिए ऐसे कारावास, जिसकी अवधि 03 माह तक हो सकेंगी या ऐसे जुर्माने से जो 10 हजार रुपये तक हो सकेगा या दोनों से और वह तीन माह की अवधि के लिए चालक अनुज्ञप्ति धारण करने के लिए अयोग्य हो जायेगा तथा किसी द्वितीय या पश्चातवर्ती अपराध के लिए ऐसे कारावास जिसकी अवधि 06 माह तक हो सकेगी या ऐसे जुर्माने से जो 10 हजार तक हो सकेगा या दोनों से दण्डनीय होगा 'दण्ड दिया जायेगा साथ ही माननीय न्यायालय के आदेशों के अवमानना पर अतिरिक्त कार्यवाही की जायेगी। आम जनमानस को यह भी सूचित किया जाता है कि यदि वह दुपहिया गोटस्थानों विशेषतया बुलेट मोटर साइकिल पर परिवर्तित (मॉडिफाइड) साइलेंसर लगाये है तो तत्काल उसको निकलवा व साथ ही दुपहिया मोटरयानो विशेषतया बुलेट मोटर साइकिल पर परिवर्तित (मॉडिफाइड) साइलेंसर के विक्रेता / लगाने वाले गैराज पर भी कार्यवाही की जायेगी।।

Ambedkar Nagar.  In the order dated 20.07.2021 by Hon'ble High Court in Public Interest Litigation No. 15385/2021 organized before Hon'ble High Court, Allahabad Bench, Lucknow, on changing the silencer in such a way by the owners/drivers of two wheeler motor vehicles, especially bullet motor cycles.  Orders have been passed to take strict action if the noise level exceeds 80 decibels prescribed in it.

 It is worth mentioning that in compliance of Hon'ble High Court order dated 20.07.2021, the general public is informed that they should not install modified silencer on their two wheeler motor vehicles especially bullet motorcycles, if the modified silencer is found to be installed then Motor Vehicle Act,  1988/ Noise Pollution (Regulation and Contral) Rules.  2000/Central Motor Vehicle Rules, 1989/ Relevant provisions of Cr.PC/Indian Penal Code/Environment Protection Act, 1986 read with Environment Pollution Rules, 1986 and various judgements pronounced by Hon'ble Constitutional Courts under Section-190 of Motor Vehicles Act  (2) Whoever drives or causes to be driven in any public place any motor vehicle which contravenes the prescribed standards with respect to road safety, research control and air pollution, shall be punished with imprisonment of either description for the first offense,  which may extend to three months, or with fine which may extend to ten thousand rupees, or with both, and shall render him unfit to hold a driver's license for a term of three months and for any second or subsequent offense with imprisonment for a term which may extend to three months.  shall be punished with imprisonment of either description for a term which may extend to six months, or shall be punishable with fine which may extend to Rs 10,000, or with both. In addition to the contempt of the orders of the Hon'ble Court, additional action will be taken.  The general public is also informed that if they have installed modified (modified) silencers on two wheelers especially bullet motorcycles, then immediately get them removed as well as sellers / installers of modified silencers on two wheelers especially bullet motorcycles.  Action will also be taken on the garage.
